Terms & Conditions

These terms and conditions apply to all bookings and rides arranged through OpenTaxi.

1. Who we are

OpenTaxi (the "OpenTaxi", "we" or "us"), established at [Straatnaam en huisnummer], [Postcode] Hoofddorp, registered with the Dutch Chamber of Commerce (KvK) under number [KvK-nummer], VAT number [BTW-nummer].

2. Definitions

  • Customer: the person or entity that books a ride.
  • Driver: the driver approved by us who performs the ride.
  • Ride: the passenger transport from the stated pickup address to the destination.
  • Platform: the website and booking service of OpenTaxi.

3. Applicability

These terms apply to every offer, booking and agreement. By placing a booking, the customer accepts these terms.

Deviations apply only where confirmed by us in writing.

4. The service

OpenTaxi provides pre-booked taxi transport in Hoofddorp and surroundings. An agreement is formed when we confirm your booking.

We make reasonable efforts to provide a suitable, approved driver and vehicle for the booked time.

5. Bookings

The customer is responsible for providing accurate and complete pickup address, destination, time, number of passengers, luggage and any special requirements.

We may refuse or cancel a booking, for example in case of incomplete information, lack of availability or suspected misuse.

6. Prices and payment

The price is calculated up front based on the route (distance and time) and the chosen vehicle, according to the applicable tariffs. The price shown up front is a fixed price, save for manifest errors and changes to the ride requested by the customer.

Payment is made online in advance (e.g. iDEAL/credit card via our payment provider) or directly to the driver (cash or card), depending on the option chosen at booking.

Waiting time, tolls, additional stops or route changes requested by the customer may be charged in addition.

7. Cancellation, changes and no-show

You may cancel a ride free of charge up to 1 hour before the booked pickup time. For later cancellations we may charge (part of) the ride price.

In case of a no-show (the customer does not appear within 15 minutes of the pickup time and cannot be reached), the full ride price is due.

Changes are subject to availability and may lead to a price adjustment.

8. No right of withdrawal

Passenger transport on a specific date or within a specific period is exempt from the statutory right of withdrawal under Article 6:230p(e) of the Dutch Civil Code. The statutory 14-day cooling-off period therefore does not apply to our rides. The cancellation rules in clause 7 apply.

9. Obligations of the customer and passengers

  • Be present on time at the stated pickup address.
  • Follow the driver's safety instructions and wear the seatbelt.
  • No dangerous, illegal, or nuisance goods or behaviour.
  • Damage to the vehicle caused by intent or gross negligence is recovered from the responsible party.
  • Notify pets, wheelchair or child-seat needs in advance at booking.

10. Airport transfers and travel time

Estimated travel times are based on normal traffic conditions. The customer is responsible for allowing sufficient margin, particularly for flights.

OpenTaxi is not liable for missed flights, connections or appointments due to traffic, weather, roadworks or other circumstances beyond our reasonable control.

11. Drivers

Rides are performed by drivers we vet and approve in advance. Drivers must hold the legally required permits and documents.

Where a driver operates as a self-employed contractor, they act for their own account and risk within the framework of these terms.

12. Liability

Our liability for passenger transport is limited in accordance with the statutory provisions for passenger transport (Book 8 of the Dutch Civil Code) and the applicable insurance.

Except in cases of intent or wilful recklessness, our liability for other damage is limited to at most the amount of the relevant ride price. We are not liable for indirect or consequential damage.

We recommend keeping valuables with you; transport of luggage and belongings is at the customer's risk.

13. Force majeure

In the event of force majeure (including extreme weather, traffic, strikes, outages or government measures), we are entitled to suspend performance or dissolve the agreement without being liable for any compensation.

14. Complaints

You can report complaints within a reasonable period, preferably within 14 days of the ride, via info@opentaxi.nl. We aim to respond within 14 days.

15. Lost property

We keep lost property for a reasonable period. Return is possible; any shipping costs are borne by the customer.

16. Privacy

Our Privacy Policy applies to the processing of personal data.

17. Amendments

We may amend these terms. The terms applicable to a booking are those in force at the time of booking.

18. Governing law and disputes

These terms are governed exclusively by Dutch law. Disputes will be submitted to the competent court of the Rechtbank Noord-Holland, locatie Haarlem, unless mandatory law provides otherwise.
